本《最终用户许可协议》（「EULA」）是您与温岭市新河壹嘉软件开发工作室（个体工商户）（许可方）之间关于 TelogFSD 软件的法律协议。
App Store 上架账户为 Apple Developer Program（个人会员资格）；该个人开发者账户持有人与运营者（经营者）为同一自然人。本 EULA 保护许可方及该个人开发者依法享有的软件权利。
若 Apple 标准 EULA 与本协议冲突，就本 App 而言以本协议为准（Apple 强制条款除外）。
我们授予您一项有限、非独占、不可转让、可撤销的许可，允许您在您拥有或控制的 Apple 设备上安装并使用 TelogFSD，仅供个人、非商业地了解您授权车辆的统计与分析（法律另有允许的除外）。
适用车辆（当前版本）：完整 Live 与官方智驾计数主要适用于已启用 FSD / 智驾（特斯拉驾驶）、HW4.0+ 且固件 2025.44.25.5+ 的车辆；详见隐私政策 §4.3。
软件、品牌、界面与派生分析逻辑的相关知识产权归许可方所有。特斯拉与 Apple 的商标、服务与数据归各自权利人所有。本协议不转让任何所有权。
可选订阅（Telog Drive Analytics）通过 Apple 应用内购买完成。参考价格：周订阅 ¥12 / 周、月订阅 ¥18 / 月、年订阅 ¥98 / 年（人民币，中国区 App Store）。具体价格以 App Store 购买页显示为准；详见用户协议。适用 Apple 的付款与退款规则。购买不授予您对源代码或商标的权利。
我们可能提供更新。在法律允许范围内，更新后继续使用视为接受更新后的 EULA。您可卸载以停止使用。
软件按「现状」提供，不含任何明示或暗示担保，包括适销性、特定用途适用性与非侵权（法律强制规定除外）。派生指标不构成安全关键指导。
在法律允许的最大范围内，许可方及同一自然人开发者不对间接、附带、特殊或后果性损害负责。若仍须承担责任，总额不超过您为相关争议所涉功能在过去 12 个月向我们支付的费用（如有）。
您删除应用或账号、或违反本 EULA 时，许可终止。第 3、6、7、9、10 条在终止后继续有效。
适用中华人民共和国法律（不含冲突法规范），法律另有强制规定的除外。

This EULA is between you and Wenling Xinhe Yijia Software Development Studio (sole proprietorship) (Licensor) for the TelogFSD software. The Apple Developer Program (Individual) account holder and the sole-proprietorship operator are the same natural person.
Limited, non-exclusive, non-transferable, revocable license to install and use TelogFSD on Apple devices you own or control for personal, non-commercial vehicle analytics.
Supported vehicles (current release): full Live and official self-driving counters primarily require active FSD / driver-assist, HW4.0+, and firmware 2025.44.25.5+ — see Privacy §4.3.
No reverse engineering, redistribution, sublicensing, removal of notices, or implying Tesla/Apple endorsement.
IP in the software and derived analytics remains with Licensor. Tesla and Apple marks remain with their owners.
Optional Telog Drive Analytics subscriptions via Apple IAP. Reference prices (CNY, China App Store): ¥12/week · ¥18/month · ¥98/year. App Store checkout price is authoritative. See Terms of Use. Apple’s payment and refund rules apply.
AS IS. Not safety-critical guidance. Liability limited to the maximum extent permitted by law.
License ends if you delete the app/account or breach this EULA. Ownership, disclaimer, and liability sections survive.
Laws of the People’s Republic of China, unless mandatory rules require otherwise.
