适用于 TelogFSD（Telog Drive Analytics）。
本《用户协议》（下称「本协议」）是您与温岭市新河壹嘉软件开发工作室（个体工商户）（下称「我们」或「运营者」）之间关于使用 TelogFSD 的法律协议。
本 App 通过 Apple Developer Program（个人会员资格）上架；该个人开发者账户持有人与运营者（经营者）为同一自然人。运营者依法由经营者承担责任；该安排不减损该自然人作为个人开发者的合法权益。
使用本 App 即表示您同意本协议、《隐私政策》与《最终用户许可协议（EULA）》。若不同意，请勿安装或使用。
1. 服务说明
- TelogFSD 是独立的特斯拉智驾 / 行程数据分析伴侣应用，提供仪表盘、趋势、行程、分享与可选 Premium 功能。
- 适用车辆（当前版本）：完整 Live 与官方智驾计数主要适用于已启用 FSD / 智驾（特斯拉驾驶）、HW4.0+ 且固件 2025.44.25.5+ 的车辆；详见隐私政策 §4.3。
- 本 App 不是特斯拉官方应用，不复制特斯拉 App 界面，报告与分享内容不构成特斯拉官方文件或背书。
- 派生指标（如智驾占比、趋势、评分）为 TelogFSD 计算，除非明确标注为特斯拉官方计数器。
2. 账号与登录
- 您可通过「通过 Apple 登录」或 Google 登录创建 TelogFSD 账号。
- 您应妥善保管第三方账号安全；因您自身原因导致的账号盗用，我们在法律允许范围内免责。
- 连接特斯拉账户为独立流程：本 App 作为特斯拉开发者平台注册的第三方应用，通过官方 OAuth 2.0 授权取得访问权限；需您另行同意，可随时在特斯拉账户或本 App 中断开。
3. Premium 订阅
- 部分高级功能需订阅 Telog Drive Analytics（App Store 自动续费订阅）。
- 可选档位与参考价格（人民币，中国区 App Store）：
- 周订阅：¥12 / 周
- 月订阅：¥18 / 月
- 年订阅：¥98 / 年
- 具体价格、税费与币种以 App Store 购买页显示为准；不同国家/地区价格可能不同。
- 付款、续费、退款由 Apple App Store 处理；我们不直接收集银行卡号。
- 订阅自动续费，您可随时在「设置 → Apple ID → 订阅」中取消。
- 订阅仅解锁本 App 功能，不改变您的车辆或特斯拉 FSD 官方订阅。
4. 可接受使用
- 仅可将本 App 用于合法的个人、非商业用途（法律另有允许的除外）。
- 不得利用导出或分享内容暗示特斯拉官方背书，或发布虚假车辆声明。
- 不得对本 App 进行反向工程、破解、滥用接口或干扰服务。
5. 知识产权
TelogFSD 的名称、界面、文案、派生分析逻辑等相关权利归运营者及权利人所有。特斯拉商标与车辆数据归各自权利人所有。本协议不授予您任何商标许可。
6. 免责声明
- 统计与派生结果仅供个人参考，不构成驾驶、安全、保险或投资建议。
- 服务按「现状」提供；我们不保证不间断、无错误或满足特定目的（法律强制规定除外）。
- 因特斯拉 API、网络、设备或第三方平台导致的数据延迟、中断或不完整，我们在法律允许范围内不承担责任。
7. 责任限制
在法律允许的最大范围内，我们对因使用或无法使用本 App 产生的间接、附带、惩罚性或后果性损害不承担责任。若依法仍须承担责任，责任上限不超过您就相关争议所涉订阅在过去 12 个月内向我们实际支付的费用（如有）。
8. 终止
您可随时停止使用、卸载 App 或删除账号。我们可在您严重违反本协议或法律要求时中止服务。终止后，本协议中关于知识产权、免责、责任限制等条款仍然有效。
9. 适用法律与争议
本协议适用中华人民共和国法律（不含冲突法）。争议由运营者住所地有管辖权的人民法院管辖，法律另有强制规定的除外。

These Terms are between you and Wenling Xinhe Yijia Software Development Studio (sole proprietorship). The Apple Developer Program (Individual) account holder and the sole-proprietorship operator are the same natural person.
By using TelogFSD you agree to these Terms, the Privacy Policy, and the EULA.
1. Service
TelogFSD is an independent Tesla analytics companion. It is not an official Tesla app and does not imply Tesla endorsement. Derived metrics are TelogFSD calculations unless labeled as official Tesla counters. Supported vehicles (current release): full Live and official self-driving counters primarily require active FSD / driver-assist, HW4.0+, and firmware 2025.44.25.5+ — see Privacy §4.3.
2. Accounts
Sign in with Apple or Google. Tesla linking authorizes TelogFSD as a third-party app on the Tesla Developer platform via official OAuth 2.0. Keep your provider accounts secure.
3. Premium
- Some advanced features require a Telog Drive Analytics auto-renewable subscription via the App Store.
- Reference prices (CNY, China App Store):
- Weekly: ¥12 / week
- Monthly: ¥18 / month
- Annual: ¥98 / year
- The price, tax, and currency shown in the App Store at purchase are authoritative. Prices may vary by country or region.
- Billing, renewal, and refunds are handled by Apple; we do not collect payment card numbers.
- Subscriptions auto-renew until cancelled in Settings → Apple ID → Subscriptions.
- Subscriptions unlock TelogFSD app features only and do not change your Tesla FSD vehicle subscription.
4. Acceptable use
No reverse engineering, misuse of APIs, or implying Tesla endorsement. Do not imply Tesla endorsement.
5. Disclaimer & liability
Provided “AS IS”. Not safety-critical advice. Liability limited to the maximum extent permitted by law, and not exceeding subscription fees you paid to us for the disputed service in the prior 12 months (if any).
6. Governing law
Laws of the People’s Republic of China, unless mandatory rules require otherwise.
